Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

eVideoInterview is an asynchronous video interview platform that allows users to record, store, and share video responses to interview questions. The Service may include features such as AI-assisted question suggestions, resume parsing, customizable question libraries, and access-code-based sharing. We may add, modify, or remove features from time to time.

3. User Accounts

Registration. To use most features of the Service, you must register for an account through our authentication provider. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

Eligibility. You must be at least 18 years old to create an account or use the Service. By creating an account, you represent and warrant that you meet this age requirement.

Account Security. You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us promptly of any unauthorized access or suspected security breach.

4. Acceptable Use

You agree not to use the Service to:

• Harass, threaten, defame, or harm any person, or engage in hate speech or discriminatory conduct;
• Upload, transmit, or share content that is illegal, obscene, violent, sexually explicit, or otherwise objectionable;
• Impersonate any person or entity, or misrepresent your identity or qualifications;
• Scrape, crawl, or use automated means to access or collect data from the Service without our prior written consent;
• Reverse engineer, decompile, or attempt to derive the source code of the Service;
• Interfere with the operation of the Service, introduce malware, or attempt to gain unauthorized access to any system or account;
• Use the Service to send spam, unsolicited commercial messages, or fraudulent communications;
• Use the Service in violation of any applicable law or regulation.

5. User Content & Licenses

Your content.You retain all ownership rights in the videos, resumes, text, and other content you upload or create through the Service (“User Content”).

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, transcode, display, and otherwise process your User Content solely for the purpose of operating, maintaining, and improving the Service and providing it to you and the people you choose to share it with. This license ends when you delete the content from the Service, except to the extent we are legally required or technically unable (e.g., backups) to delete it immediately.

Your responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to upload it.

6. Sharing Access Codes

The Service allows you to share your interview through an access code or link. You are solely responsible for who you share your access code with and how recipients use the content. Once you share an access code, anyone in possession of that code may view the associated interview unless and until you change its sharing settings or delete it. We are not liable for unauthorized redistribution of access codes by recipients you have chosen to share with.

7. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to such collection and use.

8. Subscriptions and Payments

The Service is free during our beta period. Paid tiers will be introduced; users will be notified in advance, and continued use of paid features after the introduction of a paid tier will require an active subscription. We will publish pricing and billing terms before any charges are imposed. Taxes may be added where required by law.

9. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including content licenses already granted, disclaimers, limitations of liability, and governing law) will survive.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN ANY EMPLOYMENT, INTERVIEW, OR HIRING OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EVIDEOINTERVIEW, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice within the Service before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.
